Privacy Policy

Cashify LLC ("Cashify," "we," "us") operates a marketplace platform that connects sports communities ("Cappers") with sports fans ("Subscribers"), enabling Cappers to sell access to their Discord and Telegram communities. This Privacy Policy explains how we collect, use, process, and share your personal data and outlines your privacy rights. By using our Services, you agree to the practices described in this Policy.

1. Personal Information We Collect

We collect personal information from website visitors, Subscribers, and Cappers who provide content and community access through our Services. What we collect depends on how you interact with us and applicable law.

Information You Provide Directly

Account Creation

  • Subscribers: Full name, email address, phone number, and password.
  • Cappers: Full name, email address, phone number, Cashify Handle, password, profile picture, and social channel information. You may share additional information with Subscribers through our Services.

Capper Payouts and Tax Information

Because we process payouts to Cappers, we may collect additional identity and financial information required by law, such as your Social Security Number or Tax Identification Number for tax reporting purposes (e.g., IRS Form 1099). This information is collected and processed through our payment partner, Stripe. Stripe retains this data in accordance with their own privacy policy and applicable legal obligations. Purchases and Subscriptions

We collect information related to your purchases, such as billing details. All payment processing is handled by Stripe — we do not directly collect or store payment card information. Stripe may also collect device and usage information to detect and prevent fraud. Subscription and refund terms are governed by our Terms of Service.

Linked Third-Party Accounts

To access certain features, you may link your Cashify account to a third-party platform (e.g., Twitter, Facebook, Google). Those platforms' privacy policies govern their data practices. We may receive additional information about you based on your privacy settings on those platforms.

Communications with Us

When you contact us for support, apply for a job, sign up for our email list, or otherwise communicate with us, we may collect your name, email address, phone number, and the content of your message.

Surveys, Contests, and Sweepstakes

Participation is voluntary. We may collect information you provide when completing surveys or entering contests. In some jurisdictions, we are required to publicly share information about winners.

Interactive Features

Information you submit through public features such as messaging, comments, forums, or social sharing ("Subscriber Content") may be visible to other users and is considered public unless otherwise required by law.

Job Applications

If you apply for a position through our Services, we collect your application materials (résumé, cover letter, etc.) and use them to evaluate your qualifications.

Discord and Telegram Integration Data

Our core service involves automatically provisioning and revoking access to Capper-owned Discord servers and Telegram channels on behalf of Subscribers. To do this, we integrate directly with the Discord and Telegram APIs and collect and store the following information:

  • Discord: Discord username, Discord user ID, server/channel IDs, and role assignments associated with your subscription.
  • Telegram: Telegram username and Telegram user ID associated with your subscription.

We do not collect, read, or store the content of any messages sent within Discord servers or Telegram channels. We use this integration data solely to grant access upon a successful subscription, manage your role or membership status during your subscription, and automatically revoke access when a subscription is cancelled or a payment lapses.

Our use of Discord and Telegram APIs is subject to their respective developer policies. We encourage you to review Discord's Privacy Policy at https://discord.com/privacy and Telegram's Privacy Policy at https://telegram.org/privacy.

Information Collected Automatically

When you use our Services, we automatically collect certain technical and usage information, including IP address, device identifiers, browser type, operating system, mobile carrier, general location, and pages visited.

Cookies and Similar Technologies

We and our partners use cookies, pixel tags, and similar technologies for the following purposes. By continuing to use the Platform, you consent to the use of cookies as described in this Policy.

  • Operationally Necessary: To enable access to our Services and prevent fraudulent activity.
  • Performance: To understand how our Services are used and identify areas for improvement.
  • Functionality: To remember your preferences and personalize your experience.
  • Advertising/Targeting: To deliver relevant content and advertisements.

You can manage cookie preferences through your browser or device settings. Note that disabling certain cookies may affect the functionality of our Services.

Analytics

We use PostHog to collect and analyze information about how users interact with our Services. PostHog helps us understand usage patterns, diagnose issues, and improve the product. PostHog may collect information such as page views, click events, session duration, and device information. You can learn more about PostHog's data practices at https://posthog.com/privacy.

Social Media Widgets

Our Services may include social media buttons and widgets. These features may collect your IP address and page visit information and may set cookies. Their use is governed by the privacy policies of the respective social media platforms.

Information from Other Sources

We may obtain information about you from third-party sources, such as identity verification services, data enrichment partners, or publicly available sources, and combine it with information we already hold about you.

2. How We Use Your Information

We use your information for the following purposes:

To Provide Our Services

Managing your account, providing access to our platform, processing payments and payouts, provisioning and revoking access to Discord servers and Telegram channels, facilitating transactions between Subscribers and Cappers, processing job applications, and providing customer and technical support.

Access Management

We use your Discord and Telegram integration data specifically to grant you access to the communities you subscribe to, maintain your membership and role status for the duration of your active subscription, and automatically revoke your access if your subscription is cancelled, expires, or a payment fails. When access is revoked, we retain your integration identifiers (Discord/Telegram user ID) for a reasonable period to support resubscription, dispute resolution, and auditing purposes.

Communications

We may send you transactional emails such as purchase confirmations, access provisioning notices, payment failure alerts, cancellation confirmations, and other account-related notices. We may also send marketing emails about new features, promotions, or updates. You can opt out of marketing emails at any time by clicking the unsubscribe link in any marketing email or by contacting us at privacy@cashify.co. Transactional and account-related messages are necessary for the operation of our Services and cannot be opted out of while your account remains active.

Administrative and Security Purposes

Fraud detection and prevention, identity verification, security incident monitoring, debugging, auditing, enforcing our Terms of Service and other agreements, legal compliance, and improving our internal processes.

Analytics and Product Improvement

Understanding how users engage with our Services, identifying areas for improvement, conducting research, and developing new features and products.

Marketing and Advertising

Sending promotional communications, delivering tailored content and advertisements, and building custom audiences for advertising purposes. We do not sell your personal information to third parties for their own marketing use.

Other Purposes

Any additional uses for which we have obtained your consent, as permitted by law, or as described at the time of collection.

3. How We Disclose Your Information

We may share your information with third parties in the following circumstances. We do not sell your personal information.

Service Providers

We share information with vendors and service providers who perform services on our behalf, such as payment processing (Stripe), analytics (PostHog), cloud hosting, customer support, and email delivery. These providers are contractually required to protect your information and use it only for the purposes we specify.

Cappers

When you subscribe to a Capper's community, certain account information (such as your Subscriber name and subscription status) may be accessible to that Capper in order to fulfill your subscription and manage community access. Cappers do not receive your payment information, Discord/Telegram user IDs, or any other sensitive identifiers directly — access is managed programmatically through our platform.

Discord and Telegram

To provision and revoke community access, we share necessary identifiers (such as your Discord user ID or Telegram user ID) with the Discord and Telegram APIs as required to perform role assignments and access management. We do not share any other personal information with these platforms beyond what is technically required for this purpose.

Other Users

Information you make publicly available through our platform (e.g., your Subscriber profile or public comments) may be visible to other users of our Services.

Business Partners

We may share information with business partners who offer products or services you have requested or that complement our Services.

Legal and Safety Disclosures

We may disclose your information if we believe it is necessary to comply with applicable law, a court order, or legal process; to protect the rights, property, or safety of Cashify, our users, or others; or to detect, prevent, or address fraud, security, or technical issues.

Business Transfers

If Cashify is involved in a merger, acquisition, financing, reorganization, bankruptcy, or sale of assets, your information may be transferred as part of that transaction. We will notify you via email or a notice on our Services before your information becomes subject to a different privacy policy.

4. Subscriptions, Access, and Refunds

This section explains what happens to your access and data in the context of subscription events. Full billing and subscription terms are available in our Terms of Service.

Access Provisioning

Upon a successful subscription payment, we automatically grant you access to the applicable Discord server or Telegram channel by assigning the appropriate role or membership using your linked Discord or Telegram account.

Access Revocation

If your subscription is cancelled, expires, or a payment fails, we will automatically revoke your Discord or Telegram access. You will receive an email notification when this occurs. We retain your integration identifiers (e.g., Discord/Telegram user ID and associated role data) for a reasonable period after revocation to support resubscription, auditing, and dispute resolution.

Refund Policy

Cashify's platform-wide policy is that all sales are final and no refunds are issued by default. However, individual Cappers may choose to issue refunds at their own discretion. If you believe you are entitled to a refund, please contact the Capper directly or reach out to us at privacy@cashify.co and we will do our best to assist. Refund decisions made by Cappers are not controlled by Cashify.

5. Your Privacy Choices and Rights

Your Privacy Choices

Marketing Emails: You can unsubscribe from marketing emails at any time by clicking the unsubscribe link in the email or contacting us at privacy@cashify.co.

"Do Not Track": Our Services do not currently respond to browser Do Not Track signals.

Cookies: You can control cookies through your browser or device settings. Some features may not function properly if cookies are disabled.

Discord/Telegram Integration: You may disconnect your Discord or Telegram account from Cashify at any time by contacting us at privacy@cashify.co. Please note that disconnecting your account will result in the loss of access to any active community subscriptions.

Your Privacy Rights

Depending on where you reside, you may have the following rights regarding your personal information:

  • Access: Request confirmation of whether we process your information and obtain a copy.
  • Correction: Request that we correct inaccurate or incomplete information.
  • Deletion: Request that we delete your personal information, subject to certain exceptions (e.g., we may be required to retain certain financial records by law).
  • Restriction / Objection: Request that we restrict or stop processing your information in certain circumstances.
  • Portability: Request a portable copy of your information in a machine-readable format.
  • Withdraw Consent: Where processing is based on your consent, you may withdraw it at any time without affecting the lawfulness of prior processing.

To exercise any of these rights, contact us at privacy@cashify.co. We will respond to verified requests in accordance with applicable law. If you are unsatisfied with our response, you have the right to lodge a complaint with your applicable data protection authority.

How to Submit a Privacy Request or Complaint

To submit a privacy request, correction, deletion request, or complaint, please email privacy@cashify.co with a description of your request. We will acknowledge receipt within 10 business days and aim to resolve all requests within 30 days, or within the timeframe required by applicable law. If we are unable to fulfill your request, we will explain why. Canadian residents may also escalate unresolved complaints to the Office of the Privacy Commissioner of Canada.

6. Security of Your Information

We implement reasonable administrative, technical, and physical safeguards designed to protect your information from unauthorized access, loss, misuse, or alteration. We also require our service providers and partners to maintain appropriate security measures. However, no system is completely secure, and we cannot guarantee the absolute security of your information. If we become aware of a security breach that affects your information, we will notify you as required by applicable law.

7. Retention of Personal Information

We retain your personal information for as long as necessary to fulfill the purposes described in this Policy, provide our Services, resolve disputes, enforce our agreements, and comply with applicable legal obligations. As a general guideline:

  • Active account data is retained for the life of your account. If you close your account, we will delete or anonymize your personal information within 3 years, except where retention is required by law.
  • Discord and Telegram integration data (usernames, user IDs, server IDs, role assignments) is retained for the duration of your subscription and for a reasonable period afterward to support resubscription, auditing, and dispute resolution. We do not retain message content.
  • Capper content and profile information will be removed from public view upon account closure. Records of transactions associated with Subscriber accounts may be retained for a reasonable period for dispute resolution and auditing purposes.
  • Payout and tax records (e.g., 1099 information) are retained by Stripe in accordance with their own data retention policies and applicable tax law. We retain associated payout records as required by US tax law, which generally requires financial records to be kept for a minimum of 7 years.
  • Support and communications records are generally retained for 3 years after resolution.

When information is no longer needed, we delete or anonymize it in a secure manner.

8. International Data Transfers

Cashify operates in the United States and serves users in the US and Canada. Your information may be transferred to, stored, or processed in the United States or other countries where our service providers operate. We take steps to ensure your information is handled in accordance with this Policy and applicable law wherever it is processed.

9. Supplemental Notice for California Residents

This section applies to California residents whose personal information is subject to the California Consumer Privacy Act (CCPA). Over the past 12 months, we have collected the categories of personal information described in Section 1 above. We have disclosed this information to the categories of third parties described in Section 3 for business purposes.

We do not sell your personal information, as "sell" is defined under the CCPA.

Additional California Rights

  • Non-Discrimination: We will not discriminate against you for exercising your CCPA rights.
  • Authorized Agent: You may designate an authorized agent to submit requests on your behalf. We may require verification of the agent's authority.
  • Verification: We may need to verify your identity before fulfilling a request.

Refer-a-Friend and Incentive Programs

Participation in any referral or incentive program is voluntary. We may offer rewards in exchange for providing personal information. The value of that information depends on your usage of our Services.

California Shine the Light

California residents may request a list of third parties to whom we disclosed personal information for direct marketing purposes in the past calendar year by contacting us at privacy@cashify.co.

10. Supplemental Notice for Canadian Residents

This section applies to residents of Canada whose personal information is subject to applicable Canadian privacy laws, including the Personal Information Protection and Electronic Documents Act (PIPEDA) and applicable provincial privacy legislation.

We collect, use, and disclose personal information only with your consent or as otherwise permitted by law. You have the right to:

  • Access your personal information and receive an account of how it has been used and disclosed.
  • Request correction of inaccurate or incomplete information.
  • Withdraw consent to our processing of your information, subject to legal or contractual restrictions.
  • File a complaint with the Office of the Privacy Commissioner of Canada if you believe we have not handled your information in accordance with applicable law.

To exercise any of these rights or to submit a complaint, please contact us at privacy@cashify.co. We will acknowledge your request promptly and respond within the timeframe required by applicable law. If we are unable to resolve your complaint to your satisfaction, you may escalate it to the Office of the Privacy Commissioner of Canada at www.priv.gc.ca.

11. Supplemental Notice for Nevada Residents

Nevada residents have the right to opt out of the sale of certain covered information. We do not currently sell personal information as defined under Nevada law. If you have questions, please contact us at privacy@cashify.co with "Nevada Do Not Sell Request" in the subject line.

12. Children's Information

Our Services are intended for users who are 18 years of age or older. We do not knowingly collect personal information from anyone under the age of 18. If you believe your child has provided us with personal information without your consent, please contact us immediately at privacy@cashify.co. We will delete such information and terminate the child's account as applicable.

13. Other Provisions

Governing Law

This Privacy Policy and any disputes arising from it are governed by the laws of the State of Nevada, without regard to its conflict of law principles. To the extent permitted by law, any disputes relating to this Policy shall be resolved in the courts of competent jurisdiction in Nevada.

Third-Party Websites and Applications

Our Services may contain links to third-party websites, applications, or platforms — including Discord and Telegram — that are not owned or controlled by Cashify. This Privacy Policy does not apply to those third-party services. We encourage you to review the privacy policies of any third-party services you visit or use. We are not responsible for the privacy practices of third parties.

Future AI-Powered Features

We may in the future introduce features that use automated analysis or AI-driven recommendations (e.g., personalized picks or content suggestions). If we do, we will update this Policy to describe what data is used, how decisions are made, and what rights you have with respect to automated processing, including the right to request human review where required by applicable law.

Changes to This Privacy Policy

We may update this Privacy Policy from time to time. When we make material changes, we will notify you by updating the "Last Updated" date at the top of this Policy and, where appropriate, by sending you an email notification or displaying a prominent notice within our Services. Your continued use of our Services after any update constitutes your acceptance of the revised Policy. We encourage you to review this Policy periodically.
